In Spain, the first questions for any crypto exchange are its EU MiCA authorisation and compliance with the CNMV's crypto-advertising rules. Spain is governed by EU MiCA — applied from 30 December 2024, grandfathering ending 1 July 2026 — plus the Comisión Nacional del Mercado de Valores (CNMV)'s specific requirements for mass-market crypto promotions and influencer marketing. Because promotion is restricted, Exchange Atlas shows no monetised listings to Spanish readers and publishes an information-only regulatory guide.

MiCA plus the CNMV's advertising rules
MiCA requires a CASP authorisation to serve EU clients, passportable from any one EU/EEA member state to Spain. The CNMV layers national rules on top, with specific requirements for mass-market crypto advertising and influencer promotions — Spain was an early mover on regulating crypto 'finfluencer' marketing. A CASP authorisation does not exempt an exchange from those rules.
In our June 2026 research, Coinbase, Kraken, OKX, Crypto.com, Gemini, Bitpanda and Bitstamp held confirmed full CASP authorisation; Binance, Bybit and KuCoin were not confirmed at the search date. Verify the live ESMA entry before relying on any of this.
How to verify and choose for Spain
Check the exchange's legal entity on the ESMA interim MiCA register and with the issuing national authority, and review the CNMV's information on crypto-asset providers and advertising. Confirm the Spanish terms permit the products you want and read the risk disclosures.
Cryptoassets are highly volatile and largely outside compensation-scheme protection — you can lose all you invest. This is information, not financial advice.
